Terms and Conditions for Consumers
1. How we will accept your order.
You may place an order through our website. Our acceptance of your order will take place when we email you to accept it, at which point a contract will come into existence between you and us. Once you have received your order confirmation email, your order cannot be cancelled or amended before fulfilment. Please refer to Section 10, Returns & Refunds, for our full refund policy.
2. If we cannot accept your order.
If we are unable to accept your order, we will inform you of this and will not charge you for the products. This might be because the product is out of stock, because of unexpected limits on our resources, which we could not reasonably plan for, because we have identified an error in the price or description of the product or because we are unable to meet a delivery deadline you have specified.
3. Your order number.
We will assign an order number to your order and tell you what it is when we accept your order. It will help us if you can tell us the order number whenever you contact us about your order.

Nuby UK LLP is the owner and operator of the website at www.uk.nuby.com, referred to as “the Website”, throughout these terms and conditions. These conditions apply to you, the User of the Website, regardless of how you access the Website and will cover all technologies, devices and Nuby UK products available on the Website. The User should carefully read these terms before using the Website and before placing an order or registering an account on the Website.
By accessing, navigating and/or using the Website, you agree to these terms and conditions, whether or not you open an account through the Website, register or log in with your account. If you do not accept these terms, do not use the Website, nor place any order through it.
Nuby UK provides you with a privacy policy for your review and reserves the right to change the privacy policy. Each time you use the Website, you will be under the current regulation of the Privacy Policy.
To use the Website, you may be asked to provide certain personal registration details. It is a condition of the Website that all information you provide is correct, current and complete. Nuby UK has the right to refuse service and/or access of the Website if it believes any information is not correct, current and complete.
You must be 16 years old to access the Website. Due to this age restriction for use of the Website, no information obtained by the Website falls within the Child Online Privacy Act (COPA) and is not monitored as such.

Hyper-links are to be accessed at the user’s own risk, and we recommend users read the terms and conditions on external websites as well as their privacy policy before use.
Trademarks and logos appearing on the Website are the property of Nuby UK or are licensed to Nuby. Nuby UK and any third-party licensor of trademarks and logos retain and reserve all rights to our trademarks and logos.
5. Security
Any passwords used for the Website are for individual use only. You, the User, will be responsible for the security of your password. Nuby UK is entitled to monitor your password and, at its discretion, require you to change it if they deem it necessary.
The User is prohibited from using any services or facilities to compromise or tamper with the security of the Website and/or accounts. The use of tools designed for compromising or testing security is prohibited. Nuby UK reserves the right to release your details to system administrators and/or organisations in order to assist them in resolving security incidents. Nuby UK will fully cooperate with any law enforcement authorities or court order requesting or directing Nuby UK to disclose the identity of anyone believed to violate the terms and conditions of the Website. 6. Exclusion Rights

Nuby UK has the right to refuse service and/or access of the Website if it believes any information provided is not correct, or complete and/or any terms and conditions have been violated.
7. Delivery
The delivery date provided to you is an estimated date only, not ensured and Nuby gives no guarantee of delivery by any specific date. Due to external factors beyond the control of Nuby UK the delivery date may be different from the estimated delivery date; factors such as adverse weather conditions, errors in delivery information provided, customer not available to take receipt of the delivery, legal procedures, public holidays or courier delays.
8. Purchases
All prices quoted on the Website (and other fees charged) by Nuby UK are inclusive of any taxes, duties or other governmental levies and financial charges. Nuby UK will make every effort to ensure prices are correct at the time of purchasing however, due to technical error out of Nuby UK’s control this may occasionally fail and cause mispricing. In this instance, Nuby UK will not be obliged to sell products at the incorrect price and will endeavour to contact you to cancel and refund your order.
Your order will only be processed if you have placed the order through the Website correctly, all personal details are correct, and the Website has received authorisation from the payment provider that full payment has been made from your payment card.
Nuby UK may offer promotional prices on the Website. Promotional prices will be subject to the terms of that promotion and Nuby UK reserve the right to remove promotional prices at any time. Promotions include (but are not limited to) multi-buy offers, percentage discounts, value discounts, free gift with purchase. You may be required to quote relevant promotional code when placing the order.
Discounts cannot be combined or used in conjunction with any other promotion unless Nuby UK expressly states this.
In the instance of returning goods purchased in a promotion, the total price of the products you keep will be deducted from the price of your order and the difference refunded to you, if applicable. Any promotional free gift should be returned, in an unused and resellable condition in the event that you wish to return the qualifying item. Nuby UK reserve the right to deduct the value of the free gift from your total refund if it is not returned in an unused condition along with its original packaging.
9. Complaints
If you are unhappy with your purchase or experience on the Website, you should report this to the customer service team by emailing enquiries@nuby.com in the first instance. Nuby UK will endeavour to respond within 5 working days to resolve your concern.
10. Returns & Refunds
Nuby UK offers 30 days to return unwanted, unused and unsuitable products, purchased on the Website for a full refund, providing they are returned to Nuby UK in the same unused condition, with their original packaging undamaged and proof of purchase. All returns should follow the refund and return procedure which can be found here.
For any products purchased in a discounted bundle, the current RRP of suitable products (you wish to keep) would be discounted from the total purchase price paid for the bundle. Alternatively, all products purchased in the discounted bundle would be required to be returned in an unused and unopen condition.
Nuby UK will not be liable for any returns which become lost or damaged in transit and recommend that goods are returned well-packed, using a tracked postage service to ensure delivery.
Goods should be returned in a clean condition for hygiene purposes, to allow for full inspection. Nuby UK reserve the right to reject goods returned in unsatisfactory condition. In the event a product is deemed to not be faulty or considered unhygienic to inspect, you will be responsible for the cost of returning the goods.
11. Your rights to return goods
A. You can always cancel your order and return the goods you ordered, however your rights to a full or partial refund of the price paid will depend on what you have bought and when you decide to cancel the order or return the goods:
i. if what you have bought is faulty or misdescribed you may have a legal right to return the goods (or to get the product repaired or replaced or to get some or all of your money back), see clause **;
ii. if you want to cancel the order or return the goods because of price changes, or changes in product specification, late or failed delivery, see clause ** below;
iii. if you have just changed your mind about the product ordered or delivered you may return it to us at any time before delivery and up to thirty days after receiving it;
iv. in all other cases (if we are not at fault and there is no right to change your mind), see clause **.
B. Exercising your right to change your mind.
For most products ordered or bought online you have a legal right to change your mind up to thirty (30) days after the date of receiving the products and receive a refund. These rights are explained in more detail in these terms.
C. When you don’t have the right to change your mind and return goods. You do not have a right to change your mind in respect of:
i. products sealed for health protection or hygiene purposes, once these have been unsealed or damaged after you receive them;
ii. any products which become mixed inseparably with other items after their delivery; and
iii. any products which are liable to deteriorate or expire rapidly.
